Latest Tobacco Industry Challenge to California’s S.B. 793 Dismissed

A legal challenge to California State Bill 793 waged by multiple tobacco manufacturers and retailers was dismissed by the U.S. District Court for the Southern District of California after it found that the “challenge to the constitutionality of S.B. 792 is not ripe for resolution and therefore the court lacks subject matter jurisdiction” and because of this, “the motion for preliminary injunction is denied as moot, and this case is dismissed.”

Swisher Sues FDA Over Sept. 9 Premarket Approval Enforcement

On Sept. 9, 2021, tobacco companies—albeit very few premium cigar companies—could be required to remove their products from shelves while the companies wait for the U.S. Food & Drug Administration (FDA) to grant premarket product approval for those products, products that these companies are selling.
